SERVICE TERMS & CONDITIONS
GOWAY ASIA TRAVEL - A member of Four Seasons Travel Group. We accept bookings subject to the client agreeing to the conditions set out within this section:
PLEASE NOTE IT IS YOUR RESPONSIBILITY TO ENSURE THAT:
WHEN BOOKING:
• You are aware that cancellations or amended bookings may be subject to additional charges.
• You read our booking Terms & Conditions.
• You have adequate travel insurance.
• You check all booking details and any paperwork (email or hard copy) carefully to ensure that all details are correct.
BEFORE DEPARTURE:
• You have the necessary entry visas for all the countries you are visiting.
• Your current passport remains at least 6 months validity from the date you end tour itinerary and return to your country of residence.
• Your passport must have at least two (02) blank pages for your travel to each country for visa & entry/exit stamps, not including those reserved for amendments and endorsements at the back of the passports.
• You reconfirm your flights 72 hours prior to departure.
• You have received professional medical advice and any necessary vaccinations.
RATES AND VALIDITY:
All rates are per net denominated in USD (US Dollars) exchange rate of the moment. They are valid for the dates specified in our programs. We guarantee that the prices or rates given to Client / the Agent are correct at the time of preparation of the proposal or of billing. We reserve the right to change the rates or prices if the suppliers' costs were to increase for reasons related to inflation, currency depreciation, tariff surcharges for fuel or any other event beyond the control of our society.
DEPOSIT AND BALANCE CONDITIONS:
• A deposit of 30% of total invoice is required in order to confirm all our services.
• The remaining balance should be made 45 days prior to group arrival for GIT (from 6 rooms up) and 30 days prior to group arrival for FIT (less than 6 room).
• Other special requests and incentive tours will be considered and determined case by case at the time of confirmation.
PAYMENT METHOD:
• All Payment may be made by cash, telegraphic/electronic transfer or credit card (Visa, Master and American Express card).
• Except for the cash payment, any levied charges for the telegraphic/electronic transfer or any applied surcharges for credit card banking (3.0%) should be covered by the clients.
• Following full payment, final voucher of services and related documents will be forwarded by e-mail to clients/ the Agent at a maximum of two weeks prior to your home departure.
• Failure to pay by the due date may result in unexpected cancellation of the booking without indemnity or any reimbursement.
CANCELLATION OF DOMESTIC OR INTERNATIONAL FLIGHTS:
If the cancellation occurs after a deposit or full payment was paid to the airlines, the cancellation fees for domestic flight or international flight is required according to the policy of the airlines. In these cases, we shall reserve its right to forward cancellation fee requests from the airlines to Clients/Agents. In case any non-refundable deposits have been made and agreed on, there will be reimbursement for the amount paid by our company for the airlines.
CANCELLATION POLICY:
• The Cancellation fees are depended on hotels & airlines, transportation, restaurants, guide, and other service suppliers’ policy. We will clearly inform Clients/Agents in these cases and use its best endeavors to minimize cancellation fees which can be applied to Clients/Agents.
- More than 60 days before arrival: no cancellation charge
- 14-60 days before arrival: 10% of the total tour price
- 5-13 days before arrival: 50% of the total tour price
- Less than 5 days before arrival or No shows: 100 % of the total tour price
• In case the tour participant shortens or interrupts the tour on his own account there will be no reimbursements.
• The cancellation fees could be reimbursed by the insurance company if you are insured in the event of justified cancellation (especially illness, accident, death, etc.)
• If our company is forced to cancel the departure due to unforeseeable reasons, the participants will be fully reimbursed without intention to claim for any indemnities.
CANCELATION OF EXTRA SERVICES:
For additional hotel nights and other extra services booked in connection with tour programs, cancellations will be charged as follows:
• More than 30 days prior to the service will be refunded in full
• 15 - 30 days in advance: 50% of the total price;
• Less than 15 days in advance: 100% of the total price. (Unless we can negotiate otherwise with the hotel).
CHILD DISCOUNT:
Children under 12 years are generally granted a reduction up to 10% of airfare, provided that they are accompanied by at least two full-paying adults and stays in the same room. An extra bed is fully charged as adult.
UNUSED SERVICES:
No refunds or exchanges can be made with respect to accommodation, meals, sightseeing tours, transport or any other services, included in the tour price, but not utilized by the tour members.
CANCELLATION OR MODIFICATION BY US:
Every effort will be made to operate all tours as advertised but it must be remembered that our tours are planned in advance and due to factors outside our control it may be necessary to use alternative accommodation and services in some instances. We therefore reserve the right to modify or cancel any tour, accommodation or arrangement at any time. We will notify you as soon as possible of any material changes. In the event of any material modification or cancellation we will, if possible, arrange on your behalf three alternatives:
(a) Services of an equivalent or similar standard, if available;
(b) Services of a lower standard together with a refund of the difference in price; or
(c) Cancellation with a full refund of all money paid.
RESPONSIBILITIES:
• It is committed to do its utmost to satisfy the customer and provide the services confirmed in the program. It is understood between the parties that our company acts as an intermediary between airlines, hotels, local transport companies and other local service providers. Also, we cannot be held responsible for the Clients, in case of failure or dissatisfaction of services provided by third parties.
• The Client / Agent warrants that our company shall not be responsible and/or liable for additional expenses and/or damages incurred due to any delay, accidents, natural disaster, political action or unrest. Moreover, we shall not be liable for any loss, injury, or damage to person or property, alteration of itineraries or cancellation in part or in full, caused by climatic conditions, breakdown of machinery or equipment, acts of government or other authorities, wars whether or not declared, civil disturbances, strikes, riots, thefts, epidemics, quarantines, medical or customs regulations, terrorist activities, or any other actions, omissions, conditions or other Force Majeure beyond our control. Neither we nor any of its affiliates or subsidiaries shall be or become liable or responsible for any additional expenses of liability sustained or incurred by the tour member as a result of any of the aforementioned causes.
• We shall not be responsible for any wrongful or negligent or fraudulent, omissions, changes of itinerary, cancellation or the failure of any equipment operated by any suppliers such as transportation carriers, cruise, and hotels, or any other party not directly owned or controlled by FS DMC.
• We is not responsible for a client’s failure to comply with customs regulations.
• We is not responsible for the theft or loss of any customer’s valuables or items of personal property due to the negligence of the customer.
• Many of our tour packages include activities which require care attention. Such activities include boarding and going ashore from boats, climbing hills, trekking, cycling, hiking, kayaking, and entering and exiting tombs and caves, etc. You will receive help and advice from our representatives but all activities are undertaken at your own risk. We and agents cannot be responsible for any action or event that occurs after its said employees and agents have exercised their duty and taken the necessary care.
• We reserves the right to modify or rescind the terms and conditions in whole, or in part at any time with or without notice.
SPECIAL REQUESTS:
You must let us know at the time of making your booking if you have special requests or needs (such as ground floor accommodation, disability access or specific dietary requirements). We will try to meet any request you have, however, we cannot guarantee that we will be able to accommodate every person’s needs and we make no promises and take no responsibility for special requests which we are unable to fulfil. If we reasonably feel we are unable to satisfactorily accommodate your particular needs, we reserve the right to decline the booking or ask for you to be accompanied by a person who is able to provide full assistance to you throughout your tour.
HEALTH:
You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your tour.
INSURANCE:
All passengers are required to have full travel insurance. It is the responsibility of the Consumer to read their insurance policy before they travel and ensure that the insurance scheme provides the Consumer with the requisite level of cover.
PRIVACY POLICY:
We are committed to protecting your personal information and agree to handle your personal information. In particular, you agree that in certain circumstances we are permitted to disclose your personal information to recipients. Such recipients may include the travel service providers in which they will provide a service to you or in which their business is based. Where we disclose your personal information to any person (including any overseas recipients), we will use reasonable efforts to ensure the recipient’s compliance with relevant privacy laws; however, you acknowledge that we cannot control the privacy practices of the recipient and therefore will not be liable or accountable for how the recipient handles your personal information. We encourage you to review the privacy policies of any third party service provider whose services we arrange on your behalf.
VALIDITY:
This information is only valid at the time of publication. It could be adjusted without prior notice. However, if there are any changes, we will inform on the website immediately. If you have any question about this issue, please contact us for further explanation.
